Terms of Use

These Terms of Use (the “Terms”) govern your access to and use of the Wish & Witch website at wishandwitch.com and the Wish & Witch iOS app (together, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

Wish & Witch is a reflective journaling and wellbeing product. It is not a medical, mental-health, psychological, financial, or legal service. Content is provided for reflection and entertainment only.

2. Eligibility

You must be at least 13 years old (or 16 in the EEA and UK) to use the Service. If you are under the age of majority in your country, you must have your parent or guardian’s permission.

3. Your account and data

Most of the app works without an account. If you provide an email address, you are responsible for keeping it accurate and for keeping your device secure. You can delete your data at any time via Profile → Account → Delete account inside the iOS app or by emailing hello@wishandwitch.com.

4. Subscriptions, billing, and auto-renewal (EULA)

Parts of the Service require a paid subscription. When you start a subscription, you authorise Apple (on iOS) or Stripe (on the web) to charge your payment method the displayed price, plus any applicable taxes.

• Introductory period. If you choose a paid introductory offer (for example, 7 days at an intro price), you are charged at the moment you confirm the purchase. After the introductory period, the subscription automatically converts to the full price of the plan you selected.
• Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current full price unless you cancel at least 24 hours before the end of the current period.
• How to cancel (iOS). Open Settings → [your name] → Subscriptions on your iPhone, or use the “Manage subscription” link inside the app. Cancellation takes effect at the end of the current billing period.
• How to cancel (web). Use the billing portal link we email you after purchase, or contact hello@wishandwitch.com.
• Refunds. Refunds are handled by the billing platform. For iOS, use Apple’s Report a Problem flow at reportaproblem.apple.com. For web purchases, contact us and we’ll review your request, subject to applicable consumer-protection law.

5. Acceptable use

You agree not to:

• Reverse engineer, decompile, or resell the Service.
• Use the Service to harass others or to publish illegal content.
• Attempt to access accounts or data that are not yours.
• Bypass any paywall, rate limit, or security measure.

6. AI-generated content

Parts of your reading, daily messages, and journaling prompts may be generated or assisted by AI models. AI can produce inaccurate, incomplete, or misleading statements. Do not rely on anything in the Service for medical, psychological, financial, or legal decisions. If you are in crisis or experiencing thoughts of self-harm, please contact local emergency services or a qualified professional immediately.

7. Intellectual property

The Service, including text, graphics, audio, code, and brand names, is owned by Wish & Witch or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes. Your own journal entries and wishes remain yours.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by law, Wish & Witch will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms or if required by law. Sections that by their nature should survive termination will survive.

11. Changes

We may update these Terms from time to time. If changes are material, we will update the “Last updated” date above and, where appropriate, notify you in-app or by email. Continued use after the effective date means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of your country of residence to the extent required by local consumer-protection rules; otherwise, by the laws of the jurisdiction where Wish & Witch is operated. Nothing here limits your statutory consumer rights.

13. Apple-specific terms

If you downloaded the app from the Apple App Store, you acknowledge and agree that these Terms are between you and Wish & Witch, not Apple, and Apple is not responsible for the app or its content. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms.
